Privacy Policy
How we collect, use and protect your personal information, in line with the Protection of Personal Information Act 4 of 2013 (POPIA).
Effective 13 October 2026
1. Who we are
Nkabanhle Consulting (Pty) Ltd, registration number 2026/808385/07 (“Nkabanhle”, “we”, “us”), is the responsible party for personal information collected through this website.
Our Information Officer is Lindelwa Ndwandwe CA(SA), Founder & Managing Director, registered with the Information Regulator (registration number 2026-069158). You can reach him at lindelwa.en@gmail.com or +27 71 050 9086.
2. What we collect
When you send an enquiry, we collect:
- Your full name, email address and message (required).
- Your phone number, business or company name, client type, service of interest and preferred contact method (optional).
- Your confirmation that you agree to this policy, and the time you sent the enquiry.
When you browse the site, we collect:
- Technical information that our hosting and spam-protection providers process to deliver the site securely, such as your IP address.
We do not ask for ID numbers, banking details or financial records through the website. Please do not include them in your message.
3. Why we use it, and on what basis
- Reply to your enquiry and arrange a conversation: necessary to take steps at your request before a possible engagement, and your consent.
- Keep the site and form secure and block spam: our legitimate interest in protecting the site.
- Meet legal obligations: compliance with the law.
We do not use your information for direct marketing, and we do not sell it. If you become a client, our engagement letter will explain how we handle client information.
4. Who we share it with
We share personal information only with service providers (“operators”) that help us run the website, under agreements that require them to keep it secure and confidential:
- Email delivery: Resend (resend.com), which delivers your enquiry to our inbox.
- Hosting, security and spam protection: Cloudflare, Inc.
We may also disclose information where the law requires it.
5. Information sent outside South Africa
Some of these providers store or process information outside South Africa, including in the European Union and the United States. We use providers that are bound by data-protection laws or binding agreements that give protection substantially similar to POPIA, as section 72 requires.
6. How long we keep it
We keep enquiries for 12 months after our last contact with you, unless you become a client. Client information is then kept for as long as the law requires, which for accounting and tax records is generally at least five years.
7. How we protect it
The website uses HTTPS encryption. Access to enquiries is limited to Nkabanhle staff who need it, using accounts protected by two-step verification. Form input is validated on our server. If we become aware of a security compromise affecting your information, we will notify you and the Information Regulator as POPIA requires.
8. Your rights
You may ask us to:
- Confirm whether we hold your personal information, and give you a copy of it.
- Correct or delete it.
- Stop processing it, where the law allows you to object.
- Withdraw your consent at any time. This does not affect processing that already took place.
To use these rights, contact our Information Officer at lindelwa.en@gmail.com. We will reply within a reasonable time and may need to confirm your identity first.
9. Complaints
If you are unhappy with how we handle your information, please contact us first. You may also complain to the Information Regulator (South Africa) through its website, inforegulator.org.za.
10. Children
This website is not aimed at anyone under 18, and we do not knowingly collect their information.
11. Changes to this policy
We may update this policy. The effective date at the top shows when it last changed.
